The Supreme Court, on Wednesday upheld its earlier verdict ordering a member of the House of Representatives representing, Vandikwa/Konshisha constituency, Honourable Herman Hembe to return all salaries and allowances collected before his removal from office.
The apex court, headed by the Chief Justice of Nigeria, Justice Onnoghen, while giving its final verdict on the application filed by Hembe, trashed out the application on the grounds that the law does not allow the court to review its own judgment whether it was right or wrong.
Hembe had approached the court seeking a review of the judgment as it relates to the refund of salaries and allowances.
The Court had in June declared the seat of the lawmaker vacant and ruled that Mrs. Dorathy Mato who won the All Progressive Congress (APC) party ticket for the constituency is the rightful candidate.
The court, in its ruling, ordered Hembe to return all salaries and benefits collected while in the legislature.
Hembe in his reaction told the Supreme Court, that he has spent all the salaries he collected as a member of the lower legislative chamber.
